In 1998, Larry Legania was arrested and subsequently convicted for armed robbery. The only witness against him was an alleged victim who was later convicted for several counts of cocaine distribution a few months after Larry's conviction.
The entire incident between Larry and this alleged victim was concerning a dispute over Larry's little cousin selling drugs for this very same victim..
In 2004 Larry filed his post-conviction relief establishing that his trial counsel was ineffective for failing to investigate his case and call several material witnesses that would have established Larry's alibi for the exact time frame that the alleged victim said the crime was to have occurred. Finally, after numerous set backs, Larry's post-conviction was granted in 2011. However, the state appealed the judgement and the appellate court reversed the judgment and reinstated Larry's conviction.
Disappointed but determined, Larry immediately filed a rehearing arguing the totality of the evidence and the fact that his other claims were never adjudicated. The appellate court granted Larry's rehearing and remanded his case back to the trial court for another evidentiary hearing.
In 2012 the trial court granted Larry another new trial. The state again sought writs to both the circuit and supreme courts. After a long drawn battle, Larry finally obtained his freedom on September 26, 2014. The state offered Larry a plea giving him credit for time served.
While he was incarcerated, Larry served as inmate counsel for the prison's legal program departement. Larry was responsible for interviewing inmates about their cases or consulting with them about legal issues. Larry gain extensive experience is various stages of criminal litigation. Larry has filed countless motions, direct appeal, post-conviction and federal habeas corpus pleadings.
Larry also has experience in civil litigation. In 2012 Larry was responsible for representing himself as an intervening plaintiff in a wrongful death/ medical malpractice suit in Texas against three different law firms.
